Terms & Conditions

These Terms & Conditions govern your use of the AutoNoise AI website and application (the "Service"). The Service is provided by AutoNoise ("AutoNoise", "we", "us"), trading as AutoNoise AI. You are contracting with AutoNoise.

1. Acceptance

By creating an account or continuing to use the Service you agree to these terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind it. If you use it as an individual, you confirm you are of legal age in your country.

2. What the Service does

You record or upload a vehicle noise, select the area of the vehicle and optionally describe symptoms. Our AI returns a report with likely causes, a severity indication, estimated repair costs and practical advice. Reports are generated per diagnosis and consume credits from your balance.

3. Accuracy and no professional advice

AI output may be incomplete or inaccurate. Reports are informational only and are not a substitute for inspection by a qualified mechanic, nor for professional, safety, legal or financial advice. You remain responsible for decisions about your vehicle, including whether it is safe to drive. Always have serious symptoms checked by a professional.

4. Acceptable use

You must not:

• use the Service unlawfully or for fraud, spam or abuse;
• upload content you do not have the rights to, or content that is illegal, infringing, hateful or contains recognisable third parties without consent;
• attempt to jailbreak, prompt-inject or otherwise bypass safety and content controls;
• interfere with the Service's security (malware, probing, scanning, scraping, load abuse);
• reverse engineer, resell, redistribute or circumvent technical or credit limits.

5. Your content, inputs and outputs

You keep ownership of the recordings, descriptions and notes you submit, and you grant us a limited licence to host and process them solely to operate the Service. You are responsible for your inputs, for having the rights to submit them, for verifying outputs before acting on them, and for how you use the resulting reports. Subject to your compliance with these terms, you may use the reports generated for your own vehicles, including sharing them with a mechanic.

If you believe content on the Service infringes your rights, email legal@autonoise.app with details and we will review and, where appropriate, remove it. Repeat infringement leads to account termination.

6. Content moderation

We may remove or restrict content, filter or refuse AI outputs, and suspend accounts where we reasonably believe these terms or applicable law have been breached.

7. Accounts

Provide accurate information and keep it up to date. Keep your credentials confidential; you are responsible for activity under your account.

8. Intellectual property and licence

AutoNoise retains all rights in the Service, including its software, models, prompts, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan or credit pack you have purchased.

9. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically for the selected interval until cancelled. 10. Service level and warranties

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

11. Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude indirect, consequential and special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited by law.

12. Indemnity

You indemnify us against claims arising from your content, your unlawful use of the Service or your breach of these terms.

13. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination your right to use the Service ends; you may request an export of your diagnoses within 30 days, after which data is deleted or anonymised.

14. Changes

We may update these terms; material changes will be notified in-app or by email. Continued use after the effective date means you accept the updated terms.

15. Governing law and disputes

These terms are governed by the laws of Italy, and the courts of Italy have exclusive jurisdiction, without affecting mandatory consumer protections in your country of residence.

16. General

You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or reorganisation. Neither party is liable for delays caused by events beyond its reasonable control. Contact: support@autonoise.app.
